Terms of Service

1. Nature of the Service

Novixfund ("Novixfund," "we," "us") operates an online platform that sells access to simulated cryptocurrency trading evaluations ("Challenges") and, for traders who pass them, simulated funded accounts (together, "Accounts").

Every Account is simulated. No Account places a real order on any exchange, holds real trading capital, or has custody of any cryptocurrency, security, or other asset belonging to you. Positions, balances, equity, profit and loss shown in your Account are internal ledger entries priced against live Binance perpetual futures market data, used solely to measure trading performance under a fixed set of rules.

Novixfund is not a broker, dealer, exchange, custodian, asset manager, or investment adviser, and nothing on the platform is brokerage, custody, or investment-management services. Nothing on the platform constitutes investment, legal, tax, or financial advice, and no communication from us — including marketing material, the profit calculator, or the leaderboard — should be treated as a recommendation to trade any asset.

Amounts described as "funded," "capital," or "balance" describe your position within the simulation and your eligibility for a discretionary performance payout under Section 8, not funds held on your behalf.

2. Eligibility

You must be at least 18 years old and have the legal capacity to enter into these Terms to purchase a Challenge or hold an Account.

Each natural person may hold and operate only one trading identity on the platform. You may not register or operate more than one user profile or identity, whether under your own name, a different name, or through a third party. One identity may hold several Accounts at the same time, subject to Section 4.

You are responsible for determining whether use of Novixfund is lawful in your jurisdiction. We may restrict availability of the service to residents of certain countries or regions at our discretion, including to comply with sanctions and export-control obligations.

3. Account Rules and the Rules Snapshot

Each Challenge and Account is governed by the trading rules published on the Rules page at the time the Account is created — including profit targets, maximum daily loss, maximum total loss, minimum trading days, first-trade and inactivity deadlines, leverage limits, and permitted symbols (the "Rules").

When an Account is created, it is stamped with a rules version and carries a permanent snapshot of the Rules that applied on that date. We may revise the Rules for Challenges purchased after a given date, but a revision never changes the Rules already attached to an existing Account. Your Account is always evaluated against the Rules version it was created under, for its entire lifecycle, including after a phase change or reset.

Breach of any threshold in your Account's Rules (daily loss, total loss, missed trading-day requirements, inactivity, or a first-trade deadline) is evaluated automatically and continuously against live market data, and triggers the consequences described in Section 5.

4. Prohibited Conduct

You agree not to engage in, and not to facilitate, any of the following in connection with a Novixfund Account:

  • Opening opposing positions across two or more accounts (yours or another user's) so that one of them profits regardless of market direction ("cross-account hedging");
  • Copying or mirroring the trades or signals of another person, signal service, or account manager;
  • Coordinating trades between accounts to circumvent risk limits or manufacture qualifying trading days;
  • Exploiting latency, feed lag, or discrepancies between our price feed and the live market ("latency arbitrage" or "feed arbitrage");
  • Exploiting price gaps, stale quotes, feed outages, or known engine or feed limitations to obtain risk-free or asymmetric outcomes ("gap exploitation");
  • Operating more than one trading identity, or having another person operate an Account on your behalf, in violation of Section 2;
  • Using a VPN, proxy, spoofed device or location data, or other means to misrepresent your identity, location, or account ownership for fraudulent purposes;
  • Accessing an Account from a country inconsistent with your verified identity in order to conceal who operates it;
  • Sharing your Account, login credentials, or trading access with another person, or trading an Account on behalf of someone else for compensation;
  • Using trading bots, expert advisors, or any other automated order placement, or high-frequency trading strategies;
  • Any other conduct intended to obtain a payout or pass an evaluation through means other than genuine trading decisions.

The trading policy published on our Rules page forms part of these Terms and applies to every Account as currently published.

5. Consequences of Rule Violations

If we determine, in our reasonable discretion, that an Account has breached a Rules threshold or engaged in prohibited conduct under Section 4, we may take any of the following actions, individually or in combination: - Void or reverse the trades or fills connected with the violation; - Fail the Account and close all open positions at the prevailing feed price; - Suspend or permanently close the Account; - Forfeit any pending or approved payout connected with the violation; - Refuse future purchases from the trader or any linked identity.

Where reasonably possible we will notify you of the finding and the basis for it. You may contact support@novixfund.com to request a review under Section 8.7 before a forfeiture is finalized, except in cases of suspected fraud, multiple identities, or payment fraud, where we may act immediately to protect the platform.

6. Fees and Payments

Challenge fees are due in full at checkout and are paid in USDT. Activation of your Account occurs once payment is confirmed on-chain or via our payment processor.

All fees are non-refundable once your Account is activated, except as set out in our Refund Policy. Purchasing a Challenge does not entitle you to a refund if you fail the evaluation, and passing an evaluation does not entitle you to a refund of the fee paid, except where a specific add-on (such as a fee-refund-on-pass option) is purchased and expressly states otherwise.

We do not store your payment credentials; blockchain payments are processed through public networks and, once broadcast, cannot be reversed by us.

7. Account Resets

If your Account fails, you may purchase a reset to start a new evaluation on the same plan tier, subject to the reset price and the maximum number of resets published on the plan and Rules pages. A reset creates a new Account with a fresh initial balance and the Rules version in effect at the time of the reset purchase; it does not restore or carry over the failed Account's history, balance, or Rules version.

8. Payouts

Payouts are a discretionary reward for trading a funded Account within the Rules, not a return on investment, interest, wages, or a withdrawal of custodied funds. Eligibility, timing, and amount are determined by the Rules version attached to your Account and this Section.

General payout terms, unless your Account's Rules version states otherwise: - Your first payout may be requested no earlier than 14 days after your funded Account's first qualifying trade; subsequent payouts may be requested on a weekly cadence thereafter. - The profit split starts at 80% of simulated profit to the trader and may increase with a track record of consecutive payouts, or with an eligible add-on, as published on the plan and Rules pages. - The minimum payout amount is $50. Amounts below the minimum accrue until the threshold is met. - Payouts are sent in USDT over the TRC20 or BEP20 network to a wallet address you provide and confirm. You are solely responsible for providing a correct, compatible address; funds sent to an incorrect address you supplied cannot be recovered by us. - Changing your payout wallet address is subject to a 48-hour cooldown before the new address can be used for a payout, to protect against unauthorized account access. - Identity verification (KYC) under our AML/KYC Policy must be completed and approved before your first payout is processed. - Every payout request is subject to review. We may delay, reduce, or decline a payout where we identify a Rules breach, prohibited conduct under Section 4, a pending KYC or sanctions issue, or a payment or fraud risk, and will provide the reason on request.

9. Intellectual Property

The Novixfund name, branding, website, software, trading terminal, and all associated content are owned by us or our licensors and protected by intellectual property laws. You may not copy, reverse-engineer, resell, or create derivative products from the platform without our written permission.

10. Disclaimers and Limitation of Liability

The platform and all Account data are provided "as is" and "as available." We do not guarantee uninterrupted access, that the price feed will be free of gaps or delay, or that any Account will pass an evaluation or generate a payout.

To the maximum extent permitted by law, Novixfund and its officers, employees, and service providers are not liable for indirect, incidental, consequential, or punitive damages, or for any loss of expected profit, payout, or trading opportunity, arising out of or related to your use of the platform. Our total aggregate liability to you for any claim arising from these Terms is limited to the fees you paid for the Account giving rise to the claim in the twelve months before the claim arose.

Nothing in these Terms excludes liability that cannot be excluded under applicable law.

11. Termination

You may stop using the platform at any time. We may suspend or terminate your access to the platform or any Account, with or without notice, for breach of these Terms, prohibited conduct under Section 4, suspected fraud, a legal or regulatory requirement, or where continued service would expose us to undue risk. Sections that by their nature should survive termination — including Sections 6, 9, 10, and 13 — remain in effect after termination.

12. Changes to These Terms

We may update these Terms at any time by posting a revised version on this page with a new "last updated" date. Changes apply prospectively and do not retroactively alter the Rules version attached to an Account already created, consistent with Section 3. Continued use of the platform after a change takes effect constitutes acceptance of the revised Terms.

13. Governing Law and Dispute Resolution

Before pursuing any formal claim, you agree to first submit a written complaint to support@novixfund.com and allow us a reasonable opportunity to resolve it informally. Any dispute that cannot be resolved informally will be finally settled by binding arbitration under internationally recognised arbitration rules. The seat and language of the arbitration, and the governing law, will be specified in the agreement for your Account. Nothing in this Section limits any right you have under mandatory local consumer-protection law.
